Iowa Legislature Fails to Ban Eminent Domain for Carbon Capture Pipelines
A proposed ban on eminent domain for carbon capture pipeline projects in Iowa did not pass by the end of the legislative session. The inability to enact the ban may lead to increased opposition from landowners affected by proposed projects.

The Iowa legislative session concluded without passing HF 2104, a bill aimed at prohibiting eminent domain for carbon capture pipelines. Introduced by Rep. Steven Holt, the bill faced opposition in the Senate, particularly from Majority Leader Mike Klimesh, who proposed an alternative that was not favored by Holt or landowners.
Summit Carbon Solutions currently holds the ability to use eminent domain under a conditional permit granted by the Iowa Utilities Commission in 2024. Holt is involved in a lawsuit challenging the constitutionality of this permit, which may escalate to the Iowa Supreme Court. The outcome could significantly impact landowner rights and future pipeline projects in the state.
