Louisiana Proposes Bill to Strengthen Landowner Protections
Louisiana's HB 7 aims to prohibit expropriation for carbon dioxide projects, enhancing property rights. This legislation responds to a Louisiana Supreme Court ruling emphasizing constitutional limits on eminent domain.

House Bill 7, known as the Louisiana Landowners Protection Act, is being supported by State Treasurer John Fleming. If enacted, HB 7 will prohibit private entities from using eminent domain for carbon dioxide pipeline and storage projects, enhancing private property rights.
The bill also seeks to withdraw existing authority for land use related to carbon sequestration. This initiative follows a Louisiana Supreme Court ruling on March 6, 2026, which rejected expropriation that primarily benefits private parties, reinforcing constitutional protections. The outcome of this legislation may deter potential misuse of eminent domain in Louisiana's private sector investments.
