FERC Approves ComEd Transmission Agreements for Data Centers Amid Consumer Cost Concerns
FERC approved transmission rate agreements with ComEd for data centers, which may expose households to increased electricity rates. The agreements are presumed just under the Mobile-Sierra doctrine, which requires FERC to assume negotiated contracts are reasonable unless serious public harm is demonstrated.
FERC Chairman Laura Swett indicated that ComEd intends to recover costs through rolled-in rates. However, Commissioner Judy Chang warned that reliance on these agreements without further scrutiny could lead to unjust cost shifts to consumers.
She suggested state regulators might need to mandate additional contributions from end users to protect households. FERC aims to expedite data center interconnections amid rising electricity demand.
