Idaho DEQ Sues Burley and Rexburg for Clean Water Act Violations

The Idaho Department of Environmental Quality (DEQ) has filed a lawsuit against the cities of Burley and Rexburg for violating the federal Clean Water Act at their wastewater treatment facilities. This legal action is prompted by notices of intent to sue from Snake River Waterkeeper and the Idaho Conservation League, represented by Advocates for the West and Bricklin & Newman, LLP.
Both cities have failed to meet pollution limits specified in their Clean Water Act permits for over five years. The Burley-Heyburn Industrial Park plant releases industrial wastewater into the Snake River, while the Rexburg facility discharges municipal wastewater into the South Fork of the Teton River. Continued non-compliance could lead to increased regulatory scrutiny and financial penalties for these municipalities.
