Legislation Introduced to Hold Data Centers Accountable for Energy Costs
U.S. Rep. Greg Landsman has proposed the No Harm Data Center Act, mandating data centers to bear the costs of their energy infrastructure impact. The legislation aims to promote transparency and ensure that ordinary consumers are not burdened with the financial implications of data center expansion.

The No Harm Data Center Act introduced by U.S. Rep. Greg Landsman requires data centers using over 50 megawatts of power to cover the full costs of energy infrastructure associated with their operations.
This includes the construction and upgrade of power grid facilities and prohibits utilities from passing these costs onto other consumers. The act also mandates transparency by invalidating nondisclosure agreements between public officials and data center operators.
Landsman aims to empower the Federal Energy Regulatory Commission to oversee utility rates, which raises concerns about the displacement of state regulatory authority. Ohio lawmakers are considering similar measures at the state level, emphasizing the need for a cohesive federal framework.
