New Mexico Senator Proposes Regulations for Data Center Microgrids Amid Environmental Concerns

New Mexico State Senator Jeff Steinborn (D-Las Cruces) introduced a draft bill aimed at increasing regulation of microgrids associated with data centers, including the proposed Project Jupiter in Doña Ana County. The bill seeks to ensure that these microgrids comply with the Energy Transition Act, requiring approval and oversight from state regulators.

Currently, microgrids do not adhere to state clean energy standards and may generate significant emissions. The bill mandates that microgrids producing over 20 megawatts demonstrate compliance with renewable energy standards: 40% by 2028, 50% by 2030, and 100% by 2040.

Additionally, operators would need to provide annual reports on power generation and water usage. Project Jupiter is projected to emit greenhouse gases equivalent to Albuquerque and Las Cruces combined, raising concerns about air quality and environmental impact.
