UK Introduces Environmental Compensatory Measures Reforms for Offshore Wind under 2026 Regulations
The UK government laid the Conservation of Habitats and Species (Offshore Wind) (Amendment etc.) Regulations 2026 on 26 February 2026. This initiative is part of a broader strategy to enhance offshore wind capacity, aiming to support energy security and the net zero target. The reforms introduce a compensation hierarchy for environmental measures, enabling a more flexible approach while ensuring compliance with conservation commitments. This includes the Marine Recovery Fund, which allows developers to contribute to strategic compensatory measures.

The Conservation of Habitats and Species (Offshore Wind) (Amendment etc.) Regulations 2026 were introduced on 26 February 2026 to enhance environmental compensatory measures for offshore wind projects in the UK.
This reform is aligned with the government's commitment to increase offshore wind capacity as part of its clean power mission for 2030. The Marine Recovery Fund, launched in December 2025, will assist developers in meeting compensatory requirements.
A compensation hierarchy is established, requiring a sequential approach to environmental measures, with safeguards to maintain compliance with conservation commitments. The guidance will apply to offshore waters of England, Wales, and Northern Ireland, with separate provisions for Scotland. A review of the guidance and compensation hierarchy is mandated by 30 April 2031, with ongoing monitoring of compensatory measures.
