FMCSA Issues Emergency Declaration for Truckers Transporting Heating Fuel in 10 States
The FMCSA has issued an emergency declaration allowing truckers transporting residential heating fuel to exceed normal driving hour limits in response to a pipeline break and refinery shutdown affecting 10 states, including Nebraska. This waiver, which is in effect until January 15, 2026, aims to address increased demand for propane, natural gas, and heating oil, while also mitigating challenges faced by rural residents. The declaration has led to increased traffic and longer wait times at terminals in Nebraska, Iowa, and Kansas.

The Federal Motor Carrier Safety Administration (FMCSA) issued an emergency declaration waiving some regulations for truckers transporting residential heating fuel across 10 states, including Nebraska. The declaration is in response to a pipeline break and operational issues with the Mid-American Pipeline System, as well as an unexpected refinery shutdown in Illinois.
Truck drivers carrying propane, natural gas, and heating oil are permitted to exceed normal driving hour limits until January 15, 2026, to meet heating fuel needs. This waiver affects terminals in Iowa and Kansas, leading to increased traffic and longer wait times at Nebraska terminals.
The suspended regulation aims to prevent driver fatigue but is often waived in emergencies. Nebraska Trucking Association and propane industry representatives noted that rural residents are facing significant challenges due to these disruptions.
