The U.S. Environmental Protection Agency has granted a full exemption to Delek US Holdings' refinery from federal biofuel blending mandates for the year 2024. Conversely, HF Sinclair's hardship waiver petitions for its Artesia, New Mexico, refinery were ruled ineligible, as the refinery exceeds the 75,000 barrel-per-day limit to qualify as a small refinery under the Renewable Fuel Standard (RFS).
This decision follows an emergency motion from HF Sinclair and Alon Refining Krotz Springs filed in late July, seeking a prompt ruling on their economic hardship claims. The EPA's decision can be appealed, potentially impacting future compliance strategies for affected companies. The ongoing legal challenges underscore the contentious nature of RFS regulations and their financial implications for refiners.
