Payment responsibilities for biofuels and penalties remain contentious, with variations in agreements. The BIMCO clause requires charterers to reimburse owners for FuelEU penalties, but some arrangements involve charterers providing biofuels to cover penalties. Issues around penalty multipliers and pooling strategies complicate compliance, with the BIMCO clause enabling owners to suspend performance for non-payment of penalties, though this right is often contested by charterers.
